Box Elder County has an opening for a full time Deputy County Attorney, Prosecutor (District Court).  The Deputy County Attorney, Prosecutor works under the direction of the County Attorney and the Chief Criminal Deputy in performing assigned legal duties primarily in the prosecution of criminal matters in District Court.  The Deputy County Attorney, Prosecutor may be responsible for some prosecution responsibilities in the Justice Court, Juvenile Court, and a Specialty Court (Mental Health Court, Drug Court, etc.).

 

Applicants should be a graduate from an accredited law school with a Juris Doctorate Degree in law; admission to the Utah State Bar, active status and in good standing;  and 3 to 5 years’ experience in the prosecution of criminal matters in District Court.

GENERAL PURPOSE

 

Works under the direction of the County Attorney and the Chief Criminal Deputy in performing assigned legal duties primarily in the prosecution of criminal matters in District Court.  May be responsible for some prosecution responsibilities in the Justice Court, Juvenile Court, and a Specialty Court (Mental Health Court, Drug Court, etc.).

 

SUPERVISION RECEIVED

 

Answers directly to the County Attorney and Chief Criminal Deputy, and may receive some direction and supervision from senior prosecutors.

 

SUPERVISION EXERCISED

 

Supervises assigned secretarial staff and victim advocates.

 

EXAMPLE OF DUTIES

 

Primary responsibility for prosecution of assigned criminal cases, from start to finish, in the First District Court.  This would include case screenings, filing of criminal charges, researching and responding to all associated motions, and prosecuting cases through both jury and bench trials. May also receive some prosecution responsibilities in the Box Elder County Justice Court, First District Juvenile Court, and/or Specialty Courts.

 

Will have responsibility for consultation with various law enforcement agencies, (UHP, Box Elder County Sheriff and local police departments) with regards to potential criminal charges, legal advice, and case preparation.

 

May also be responsible for some training of law enforcement personnel.

 

Will also have some responsibility for supervising and managing secretarial staff and victim advocates.

 

Other related duties as assigned. 

 

Will be required to be actively engaged, either at the assigned office or in Court, between the hours of 8:30 a.m. and 5:00 p.m., Monday through Friday, excepting holidays and vacation, unless otherwise arranged and approved by County Attorney.

 

 

 

MINIMUM QUALIFICATIONS

 

            1.         Education and Experience:

 

  1. Graduation from an accredited law school with a Juris Doctorate Degree in law;
  2. Admission to the Utah State Bar, active status and in good standing;

 

AND

 

  1. 3 to 5 years’ experience in the prosecution of criminal matters in District Court.

 

 

            2.         Necessary Knowledge, Skills and Abilities:

 

  1. Knowledge of legal document format, research methods and techniques, courtroom           procedures, state and constitutional law, state and local government organizations,           criminal justice system, County Attorney policies and procedures.
  2. Familiarity with computers and computer software such that office “paperless” prosecution case management system can be effectively and efficiently utilized and as necessary, electronic media presentations can be made in court.
  3. Ability to communicate clearly and concisely orally and in writing; relate effectively with individuals from various social, economic and ethnic backgrounds; work well with law enforcement officers; think and reason logically and systematically; perform effectively in stressful situations, provide competent legal advice and guidance in public settings.

 

SPECIAL REQUIREMENTS

 

Must be bondable and able to pass a criminal background check.  Must have a license to practice law in the state of Utah and be a member in good standing of the Utah State Bar Association.  Must possess a valid Utah driver's license.  This is an at-will position and serves at the will of the County Attorney.

 

In order to avoid conflicts, and because the salary is that of a full-time position, this employee will not practice law in any fashion, anywhere, except as specifically authorized by the County Attorney.

 

The person holding this position will fill out a time card, as requested and directed by the County Attorney, strictly for the purpose of determining when and how the work is being accomplished.
