BOX ELDER COUNTY COMMISSION
OCTOBER 11, 2005

The Board of County Commissioners of Box Elder County, Utah met in a work session at the County Courthouse, 01 South Main Street in Brigham City, Utah at 8:00 a.m. on OCTOBER 11, 2005. The following members were present:

Chairman Hansen called the regular session to order at 9:00 a.m. with the following members present, constituting a quorum:

Commissioner Davis offered the prayer.
APPROVAL OF MINUTES
THE MINUTES OF THE REGULAR MEETING OF OCTOBER 04, 2005 WERE APPROVED AS WRITTEN ON A MOTION BY COMMISSIONER DAVIS, SECONDED BY COMMISSIONER REES AND UNANIMOUSLY CARRIED.

County Deputy Auditor Linda Westley said the County has received 149 appeals. There were 61 appeals with no change. The County will be holding 5-6 formal hearings next week. County Assessor/Treasurer Monte Munns explained the changes in taxable values.
MOTION: A motion was made by Commissioner Davis to move and accept the Box Elder County Board of Equalization 2005 report that shows a total decrease in taxable value in the amount of $1,061,136. The motion was seconded by Commissioner Rees and unanimously carried.

The Commissioners took a recess at 9:15 a.m. and reconvened at 9:30 a.m.
WEATHER MODIFICATION – VONEENE JORGENSEN/CHARLES HOLMGREN
Voneene Jorgensen, General Manager, said the Bear River Water Conservancy District has appreciated the County’s participation in the past. Ms. Jorgensen said the cost to run the generator has gone up this year from $4.50 per hour to $5.00 per hour, which has raised the cost by $1,250. This year’s contract is $44,400. In the last board meeting, the Bear River Water Conservancy District voted to go forward and proceed with this year’s cloud seeding.
Charles Holmgren, Bear River Canal Company, said they are the biggest water user of any entity within Box Elder County, and they have agreed to participate with $3,000 to help the cause of the cloud seeding project.
Ms. Jorgensen said in previous years, the County has paid $12,000. The Conservancy District would subtract the $3,000 from the Canal Company and also ask the Farm Bureau, Duck Clubs, Gun Clubs and PacifiCorp to contribute. The contributions will be subtracted from the $12,000. She said the Board has decided to take on the whole project next year. The most the Conservancy District will be asking the County to pay is $9,000.
Commissioner Davis said his accounting firm, Davis and Bott, does annual auditing for the Bear River Water Conservancy District. Commissioner Davis does not work on the account but wanted to declare his conflict of interest.
Voneene Jorgensen will contact the other entities and see what type of support she receives and then bring the information back.
Commissioner Rees will contact PacifiCorp.
2006 BRIGHAM CITY HERITAGE ARTS FESTIVAL – PAUL LARSEN/JOLENE CROCKETT
Paul Larsen said he and Jolene Crocket are requesting permission to use the County Courthouse and facilities for the Brigham City Heritage Arts Festival scheduled for Saturday, June 17, 2006. The theme is the history of the Migratory Bird Refuge. Commissioner Rees complimented the City for the Heritage Arts Festivals that have been held the past two years. She said they were tremendous.
MOTION: A motion was made by Commissioner Rees to participate with the Brigham City Arts Festival for June 17, 2006 and allow them to use the building so they can go ahead with their planning and know the space is available. The motion was seconded by Commissioner Davis and unanimously carried.
FLOOD & DRAIN WATER FROM NEW SUBDIVISION – BOB DAVIS
Bob Davis asked the Commissioners where they were with the concerns he brought before them last spring. He feels the County has encroached on his property in South Willard with drain water. His other problem is the flood waters are draining into his irrigation pipes.
County Planner Garth Day will look at the problems with Engineer Chris Wight and follow-up.
WARRANT REGISTER – COMMISSIONERS
The warrant register was signed, and the following claims were approved for payment: Claims number 39920 thru 40020 in the amount of $381,023.77.

ADJOURNMENT
A motion was made by Commissioner Davis to adjourn. Commissioner Rees seconded the motion, and the meeting adjourned at 10:35 a.m.
