The Board of County
Commissioners of Box Elder County, Utah met in a work session at the County
Courthouse, 01 South Main Street in Brigham City, Utah at 8:00 a.m. on APRIL
05, 2005. The following members
were present:

was called to order by Chairman Hansen at 9:00 a.m. with the following members
present, constituting a quorum:

APPROVAL OF MINUTES
THE MINUTES OF THE
REGULAR MEETING OF MARCH 29, 2005 WERE APPROVED ON A MOTION AS WRITTEN BY COMMISSIONER REES, SECONDED BY COMMISSIONER DAVIS AND UNANIMOUSLY CARRIED.

FOLLOW-UP BUSINESS
Candy Machines
Chairman Hansen proposed that the candy machines be taken out of the
courthouse. They have become a
maintenance problem.
MOTION: A motion
was made by Commissioner Rees to refer
the matter to Donnie Tarver and give Donnie the authority to remove the
machines from the building and to communicate the concern of the Commission
that there be no candy machines in the courthouse. The motion was seconded by Commissioner
Davis and unanimously carried.
County Courthouse
Flag
Chairman Hansen said that Governor Huntsman has requested that flags on
state and county buildings fly at half-staff until the funeral of Pope John
Paul II.
MOTION: A motion
was made by Commissioner Davis to fly
the County Courthouse flag at half-staff until Friday at noon to show respect
for Pope John Paul II. The motion was
seconded by Commissioner Rees and
unanimously carried.
County Landfill
Commissioner Rees stated as of Monday, Box Elder County is taking Weber
County’s garbage through Allied for 4-6 months at a rate of $18.75 per
ton. Commissioner Rees stated that our
County is building a convenience center at the landfill so cars can dump
garbage and will not be with the trucks.
The money from Weber County will enable us to make that convenience and
safety factor at the landfill.

OUT-OF-STATE TRAVEL
– LYNN YEATES
Deputy Sheriff Lynn Yeates made a request to the Commissioners to grant
out-of-state travel to Debbie Gates to attend the National Association of
Extradition of Officials Training Conference June 4-8 in Portland, Oregon at a
cost of $1,460 which is allocated in the budget.
MOTION: A motion
was made by Commissioner Rees to allow
Debbie Gates to attend the National Association of Extradition of Officials
Training Conference June 4-8 in Portland, Oregon at a cost of $1,460. The motion was seconded by Commissioner Davis and unanimously carried.
AMBULANCE HARDSHIP
POLICY – LYNN YEATES
Deputy County Sheriff Lynn Yeates presented the Ambulance Hardship
Resolution with all the changes the Commissioners had requested.

MOTION: A motion
was made by Commissioner Davis to adopt
Resolution No. 05-05, a resolution adopting the Box Elder County Ambulance
Service Policy and Procedures for hardship cases and non-payment of bills. The motion was seconded by Commissioner Rees and unanimously carried.

The Commission took a recess at 9:27 a.m. and reconvened at 10:00 a.m.
CHILD ABUSE
PREVENTION MONTH – KATHY TROUT
Kathy Trout, Director of the Box Elder Family Support Center, presented
the Commissioners with wristbands that say, “Keep Kids Safe” for those in
attendance. They were asked to wear the
wristbands during the month of April in an effort to increase the awareness of
child abuse and its prevention in our community. With the wristband was a business card with some information
about the Box Elder Family Support Center services on one side; on the other
side were some suggestions on “How You Can Prevent Child Abuse”. The Center also presented stars and everyone
was asked to write a wish for the children on the star. The stars were collected and will be
laminated and put on a “Wishing Tree” at the Center for all to see.
Ms. Trout said children represent one-quarter of American crime
victims. They suffer abuse at the hands
of their parents and caretakers; they are victimized by strangers; are exposed
to violence when they witness crimes in their homes and neighborhoods. Over 3 million children are abused annually
with the child abuse being the single-leading cause of death for children ages
four and younger in the United States.
Three children die as a result of child abuse in their home each
day. In Utah in 2004, 20,999 children
suffered from abuse and neglect. There
were 234 in Box Elder County; however, this number is down 13 child victims
from 2003 which is a step in the right direction. There were 56 victims that suffered from Domestic Violence
Related Child Abuse, 53 Sexual Abuse and 26 Physical Abuse. Ribbons were placed on trees down Brigham
City Main Street to help people remember that they represent the thousands of
children that have been abused or neglected in our County.
The Box Elder Family Support Center expressed its appreciation to the
County Commissioners, the Division of Child and Family Services and Your
Community in Unity for their support and efforts to increase awareness of child
abuse and its prevention. Ms. Trout
said child maltreatment is a community problem; no single agency or individual
has the necessary knowledge, skills, or resources to provide the assistance to abused
and neglected children and their families.
She said with the help of the citizens of Box Elder County and other
dedicated individuals and organizations working together, our wishes will come
true for the children of Box Elder County.
There were 234 pairs of shoes placed on the courthouse steps
representing the 234 child abuse victims in 2004 in Box Elder County.
Chairman Hansen read the proclamation:

MOTION: A motion
was made by Commissioner Davis to
approve the adoption of the proclamation declaring April as Child Abuse
Prevention Month for Box Elder County.
The motion was seconded by Commissioner
Rees and unanimously carried.
RECESS
The Commissioners took a recess at 10:10 a.m. and reconvened at 10:20
a.m.
EXECUTIVE SESSION
1. Strategy session to
discuss the purchase, exchange, or lease of real property when public
discussion of the transaction would disclose the appraisal or estimated value
of the property under consideration or prevent the public body from completing
the transaction on the best possible terms.
2. Strategy session
for “imminent” litigation
MOTION: At 10:22 a.m. a motion was made by Commissioner Rees to move into an executive
session to discuss personnel issues.
The motion was seconded by Commissioner
Davis and the motion was unanimously carried.
MOTION: At 10:55 a.m. a motion was made by Commissioner Rees to reconvene into regular
commission meeting. Commissioner Davis seconded the motion, and
regular commission meeting was reconvened.
Chairman Hansen
stated that there was a discussion on the purchase, exchange or lease of real
property and also a discussion on imminent litigation.
ADJOURNMENT
A motion was made
by Commissioner Rees to adjourn. Commissioner
Davis seconded the motion, and the meeting adjourned at 10:56 a.m.
