JUNE 15, 2004
The Board of County
Commissioners of Box Elder County, Utah met in a work session at the County
Courthouse, 01 South Main Street in Brigham City, Utah at 8:00 a.m. on JUNE
15, 2004. The following members
were present:

was called to order by Chairman Rees at 9:00 a.m. with the following members
present, constituting a quorum:

APPROVAL OF MINUTES
THE MINUTES OF THE
REGULAR MEETING OF JUNE 08, 2004 WERE APPROVED ON A MOTIONAS WRITTEN BY COMMISSIONER HANSEN, SECONDED BY CHAIRMAN REES AND UNANIMOUSLY CARRIED.

NO. 1
Susan Thackeray said a
company expressing an interest in the agri-business park has contacted the
Economic Development Department. The
company has asked Susan and Garth to attend a meeting in Kentucky and visit
with the company and the project manager overseeing the building. Ms. Thackeray
said the money for the out-of-state travel will come out of the RDA Budget.
MOTION: A motion was
made by Commissioner Hansen to
authorize travel for Susan Thackeray and Garth Day to attend a meeting in
Dunnville, Kentucky, June 21-24. The
motion was seconded by Chairman Rees
and unanimously carried.
MOTION: A motion was made by Commissioner Hansen to fund the Tourism Tax Advisory Board at
an amount to be determined after review of the proposal. This is to be an amount not to exceed 20% of
the annual allocation of the Restaurant Tax.
The motion was seconded by Chairman
Rees and unanimously carried.
This item was cancelled.
MOTION: A motion was
made by Commissioner Hansen that we
continue as we have in the past with a normal cut-off date for the agenda of
Thursday at noon and backup must be turned in by noon on Friday. Staff reports and correspondence will be
added to each work session, a blanket subdivision review and consent agenda will
be added to the regular agenda. The
motion was seconded by Chairman Rees
and unanimously carried.
A RESOLUTION OF THE COUNTY COMMISSION OF BOX ELDER COUNTY, UTAH APPOINTING A BOARD OF EQUALIZATION AND REVIEW FOR THE BOX ELDER COUNTY, UTAH SPECIAL IMPROVEMENT DISTRICT NO. 2003-01; SETTING THE DATES FOR THE BOARD OF EQUALIZATION TO HEAR AND CONSIDER OBJECTIONS AND CORRECTIONS TO ANY PROPOSED ASSESSMENTS; AUTHORIZING THE COUNTY CLERK/RECORDER TO PUBLISH AND MAIL A NOTICE OF MEETING OF SAID BOARD OF EQUALIZATION AND REVIEW; AND RELATED MATTERS
County Planner
Garth Day said the County received three (3) bids to do the project last week
and was pleasantly surprised with the bid results. All the roads will be redone and after the roads are brought up
to standard, the County will accept all four miles and will maintain them.
Marc Edminster,
Lewis Young Robertson & Burningham, said when the Special Improvement
District was created, the property owners had a chance to address the
Commissioners. Due to engineering
complications, nothing happened last year.
The original figure given to the property owners was approximately
$500,000 and the low bid was $336,000, a substantial reduction of what the
property owners had initially been told.
Mr. Edminster said the next step is for the appointment of a Board of
Equalization, awarding the project construction contract and to hold Board of
Equalization Hearings. Mr. Edminster
reviewed the schedule.
Bonding Attorney
Eric Johnson said by law the Board of Equalization must consist of the Chair
and members of the County Commission, County Attorney or a representative of
that office and the County Engineer or a representative of that office. Any three members can act at the hearings of
the Board, as long as at least one of the members is a member of the County
Commission.
MOTION: A motion was made by Commissioner Hansen to adopt Resolution 04-17, a resolution of
the County Commission of Box Elder County, Utah appointing a Board of
Equalization and Review for the Box Elder County, Utah Special Improvement
District No. 2003-1; setting the dates for the Board of Equalization to hear
and consider objections and corrections to any proposed assessments;
authorizing the County Clerk/Recorder to publish and mail a notice of meeting
of said Board of Equalization and Review; and related matters. The motion was seconded by Chairman Rees and unanimously carried.

The Commissioners
took a recess at 9:33 a.m. and reconvened at 10:10 a.m.

register was signed, and the following claims were approved for payment: Claims number 31647 thru 31654 in the amount
of $24,819.82. Claims number 31655 thru 31769 in the amount of $102,402.08.

RESOLUTION/UTAH
MILITARY APPRECIATION WEEK – COMMISSIONERS
MOTION: A motion was made by Commissioner Hansen to adopt Resolution No. 04-16, a resolution
declaring the week of June 12-19, 2004 as Military Appreciation Week in Box
Elder County. The motion was seconded
by Chairman Rees and unanimously
carried.
Garth Day read a
tribute and the resolution.

ADJOURNMENT
A motion was made
by Commissioner Hansen to adjourn. Chairman
Rees seconded the motion, and the meeting adjourned at 10:13 a.m.
