The Board of County
Commissioners of Box Elder County, Utah met in a work session at the County
Courthouse, 01 South Main Street in Brigham City, Utah at 8:00 a.m. on MARCH
16, 2004. The following members

APPROVAL OF MINUTES
THE MINUTES OF THE
REGULAR MEETING OF MARCH 09, 2004 WERE APPROVED ON A MOTION BY COMMISSIONER DAVIS, SECONDED BY COMMISSIONER HANSENAND UNANIMOUSLY CARRIED
WITH THE FOLLOWING CORRECTION: IN THE MOTION UNDER DAN NORMAN SUBDIVISION, THE
WORD NORMAN WAS INSERTED.

FOLLOW-UP BUSINESS
Wilderness Area
Commissioner Hansen
Commissioner Hansen said almost every County was represented in St. George last week as well as the Governor and Lt. Governor. The question was how to proceed with the wilderness designation for Utah. Commissioner Hansen showed a proposed wilderness area map, which represented an additional 3 million acres. None of the land was in Box Elder County. The proposed Pilot Mountain did not meet the criteria. Commissioner Hansen feels they have a plan of action and a fair chance of passing the proposed wilderness plan. Commissioner Hansen said one-half of the proposed land is in Kane and Garfield Counties.
PEACH DAYS MONICA
HOLDAWAY
Monica Holdaway,
Brigham City Area Chamber of Commerce Executive Director, said Peach Days will
be September 9, 10 and 11. Because it
falls on September 11, the Chamber is choosing a patriotic theme. Ms. Holdaway asked the Commissioners for
permission to use the County parking lot for food booths the same as last
year. She said everyone loved having
the booths out of the street, and they enjoyed the lawn and shade. She discussed the issue of the right-of-way
through the county parking lot for the buildings to the south of the
courthouse. Mr. Beecher said there is a
14-foot easement and directed the Chamber to contact Richard Vandyke. Ms. Holdaway asked for permission to use the
paved parking lot on Friday, and the County employees will be issued parking
permits to park in the dirt parking lot.
She asked for permission to have a water spigot so the food vendors can
have access to water. Mr. Beecher said
the request could be accommodated but to make sure there is no leakage and that
the hoses are protected so people do not trip over them. Mr. Beecher asked that the fruit display be
covered and protected so the fruit is not thrown.
WORK POLICY VII
EMPLOYEE HANDBOOK PEGGY MADSEN
Personnel Director Peggy Madsen reviewed the work policies with the Commissioners.
(See Attachment No. 2 Work Policies.)
MOTION: A motion was made by Commissioner Davis to approve the work policies in the Box
Elder County Employees Manual under paragraph VII as outlined on the two pages
as amended. The motion was seconded by Commissioner Hansen and unanimously carried.
TAX DEFERRAL
LINDA WESTLEY
Deputy Auditor Linda Westley presented a notice of tax
deferral for Hernan Macedo. She stated
he would be making payments of $100.00 per month until the taxes are paid.
MOTION: A motion was made by Commissioner Davis to approve the application for a tax
deferral for Hernan Macedo. The motion
was seconded by Commissioner Hansen and
unanimously carried.
Eric Packer, new
Executive Director for the Bear River Valley Nursing Home, came to meet the
County Commissioners. He recently came
from Panguitch and had a really good relationship with the Commissioners in
Garfield County. The Commissioners told
Mr. Packer that traditionally they visit the nursing home once a year and at
that time they discuss problems and concerns.
The Commissioners said they look forward to visiting with Eric Packer
onsite.
CHILD ABUSE
PREVENTION MONTH KATHY TROUT
Kathy Trout, Director of Box Elder Family Support Center, stated that April is Child Abuse Prevention Month. The Governor will be signing a proclamation on April 5 declaring April as Child Abuse Prevention Month. Ms. Trout said in Box Elder County they had 247 victims of child abuse last year. She said they would like to have 247 pairs of shoes on the steps of the courthouse to signify the abuse of each child. There were 63 domestic child abuse cases and 54 sexual abuse cases. Of the 247 cases the Family Support Center housed 40 children until they were put into a more permanent situation. Ms. Trout said the goal is to decrease the cases each year. The goal of the Family Support Center is prevention. They try to strengthen the family unit and to have the children stay in their own home and be safe.
Chairman Rees
commended Kathy Trout for her wonderful work to rescue the children.
MOTION: A motion was made by Commissioner Davis to adopt a proclamation declaring April as
Child Abuse Prevention Month in Box Elder County and authorize Chairman Rees to
sign the proclamation. The motion was seconded by Commissioner
Hansen and unanimously carried.
NEIL HARPER
SUBDIVISION GARTH DAY
County Planner Garth Day said the Neil Harper Subdivision is a one-lot subdivision located at about 6490 W. 2400 N. in the West Corinne Area. The property is currently unzoned, and the proposed lot is 1.25 acres. There is an existing manufactured home on the property. All utilities exist. The petition is in accordance with existing subdivision ordinances and zoning requirements, and the Planning Commission recommends granting final approval.
MOTION: A motion was made by Commissioner Davis to approve the Neil Harper One-Lot
Subdivision. The motion was seconded by
Commissioner Hansen and unanimously
carried.
SURPLUS PROPERTY
DISPOSAL REPORT DENTON BEECHER
County Surveyor
Denton Beecher gave the Commissioners a letter from the Planning Commission
recommending disposing the surplus properties as listed. (See Attachment No.
3 List of Surplus Properties.) The disposition of the real properties as
listed conforms with the Box Elder County General Plan and the Land Use
Management and Development Code
MOTION: A motion was made by Commissioner Davis to set a public hearing for the sale of
surplus property on April 13 at 9:30 a.m., and that the County Clerk give
proper notice. The motion was seconded
by Commissioner Hansen and unanimously
carried.
DWR/CHECK
PRESENTATION BOB HASENYAGER
Bob Hasenyager, Northern Regional Supervisor for the Division of Wildlife Resources, presented the Commissioners with a check for payment in lieu of taxes in the amount of $11,029.89. The Commissioner expressed gratitude for the check.
The Commissioners
asked Mr. Hasenyager to check into their policy on spraying mosquitoes.
Bob Hasenyager said
DWR would like to reintroduce the Least Chub Fish to Box Elder County. He said
there are a couple of ponds out west that they would like to move the fish
into.

register was signed, and the following claims were approved for payment: Claims number 30114 thru 30202 in the amount
of $63,918.35. Claims number 17657,
17684, 18971, 19107, 19520, 23463 and 27636 were voided.

A motion was made
by Commissioner Davis to adjourn. Chairman
Rees seconded the motion, and the meeting adjourned at 10:28 a.m.
